Arbitration

Arbitration is a process in which a third party is chosen by the parties to decide a solution to the conflict. This process resembles the Court system in that, like a judge, the arbitrator(s) decide what the parties must do to solve their conflict.

The arbitrator or panel of arbitrators holds hearings, examines evidence, applies the rules of procedure and issues decisions which then can be made to have the effect of a Superior Court Judgment.

Advantages of arbitration

As previously mentioned (see the section on Arbitration Services), the advantages of arbitration are:

  1. Arbitration saves the parties money
  2. The process is faster than going to trial
  3. The process is confidential
  4. The process is less formal than going to court
  5. The parties can choose their arbitrator(s)
